Disclosure Regarding Collection and Use of Personal Information

Thank you for visiting Frances Found’s websites. This notice describes the Company’s online information collection and use practices and the Client’s options regarding the way in which such information is used and shared. Please take the time to read and understand this policy regarding the use of personal information.

Collected Information.

Frances Found’s websites collects the following information when possible:
First Name, Last Name, and Email address

The Company may also collect certain non-personally identifiable information (i.e. generic information that does not identify the Client personally) when the Company’s web pages are visited, such as the Client’s browser type (i.e., Internet Explorer, Safari, Chrome, Firefox), type of operating system, (i.e., Windows or Macintosh), and the Internet service provider domain name.

Use and Disclosure of Information.

The Company will use the personal information provided by the Client online for the purpose(s) submitted. The Client’s First Name, Last Name, and Email Address, will be used to send purchase-related content. In addition, the Company may send emails offering products or services that may be deemed of interest to the Client. If the Client wishes the Company to stop using the personal information provided in these ways, the Client may opt out by clicking the unsubscribe link at the bottom of any communication from Frances Found's websites.

 The Company may disclose the Client’s personally identifiable information in response to subpoenas, court orders, or other legal process, or to establish or exercise legal rights or to defend against legal claims. The Company may also disclose personally identifiable information when it is perceived necessary or desirable in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, and/or to protect the Company’s rights and property.

Sharing of Personal Information.

The Company agrees not to share the personal information provided by the Client except with the Client’s explicit permission.

The Company’s business needs may change and the Company reserves the right to make changes to the Privacy Policy. Unless stated otherwise, the current Privacy Policy applies to all information that the Company possesses regarding the Client and the Client’s account. The Company will not materially change policies and practices resulting in less protection of customer information collected in the past without the consent of the affected customers.

The Company’s operations and maintenance contractors may have limited access to the Client’s personally identifiable information in the course of providing products or services to Frances Found's websites. These contractors include vendors and suppliers providing credit card processing, email distribution technology, services, and/or content for the operation and maintenance of websites. Access to the Client’s personally identifiable information by these contractors is limited to the information reasonably necessary for the contractor to perform its limited function. The Company contractually requires that all operations and maintenance contractors;

1) protect the privacy of the Client’s personally identifiable information consistent with this Privacy Policy;

2) refrain from using or disclosing the Client’s personally identifiable information for any purpose other than providing the Company with products and services as required by law.

 Frances Found is committed to handling your customer information with high standards of information security. We maintain physical, electronic, and procedural safeguards in compliance with federal regulations to guard the Client’s nonpublic personal information.

Use and Disclosure of Anonymous Information.

The Company may occasionally use any collected non-personally identifiable information to improve the design and content of the Company’s websites and to personalize the Client’s online experience. The Company may also use this information in the aggregate to analyze site usage, as well as to offer the Client products, programs, or services. Aggregate information may also be shared with others, including affiliated companies and non-affiliated companies.

Collection of Information by Others.

The Company’s site may contain links to other sites whose information practices may be different than the Company's practices identified herein. The Client is responsible for verifying the other sites’ privacy notices. The Company has no control over information that is submitted to or collected by other sites.

Cookies.

To enhance the Client’s online experience, many of the Company’s web pages use “cookies.” Cookies are text files placed on the user’s hard disk by a web server to store the user’s preferences. Cookies, by themselves, do not identify a user’s email address or other personally identifiable information, unless it is chosen to be provided by the user. However, once the user chooses to provide any personally identifiable information, this information may be linked to the data stored in the cookie. Cookies cannot be used to run programs or deliver viruses to your computer.

 The Company uses cookies as a convenience feature to save the user’s time, to understand how the Company’s site is used, and to improve the content and offerings on the site. For example, cookies may be used to personalize the user’s online experience or recall a user’s specific information on subsequent visits (i.e., to recognize a user by name when they return to the site). Any user may opt to have their browser reject cookies without any effect on the use of the Company’s site. If cookies are rejected, a user may need to re-register with the Company each time the site is visited, in order to participate in certain promotions. Any other business that advertises on the Company’s web site (and their agents) may use their own cookies. This policy does not cover how these companies use their cookies.

Web Beacons.

Some of the Company’s web pages may contain electronic images known as “web beacons,” which are also called “single-pixel gifs.” These images allow the Company to count users who have visited those pages and to deliver co-branded services. Web beacons are not used to access any personally identifiable information, but are a technique to compile aggregated website statistics. Web beacons collect only a limited set of information including a cookie number, time and date of a page view, and a description of the page on which the Web beacon resides. Some web pages may also contain web beacons in place to determine the effectiveness of advertising campaigns.

Discussions and Community Tools; Testimonials.

The Client agrees that any information submitted to the Company through Frances Found's websites may be used for promotional purposes. Due to the public nature of some services, the Client should exercise caution when deciding to disclose any personal information. The Company may also use a limited amount of information, such as first name, last initial, city, and state/province in marketing materials on the website. The Client’s registration constitutes consent to this use.

International Users.

If a user is visiting France Found's websites from a location outside of Canada, the user’s connection will be through and to servers located in Canada, and all information provided will be processed and securely maintained in the Company’s web servers and internal systems located within Canada. By using the Company’s websites, the user authorizes and specifically consents to the transfer of their personal information to Canada and its storage and use as specified above.

Accessing or Editing Personal Information.

To protect the Client’s privacy and security, the Company may take reasonable steps to verify the Client’s identity before granting access or making corrections.

DUTY TO READ

I, the Client, do hereby accept that under this agreement, I have a duty to read this sales agreement and disclosure policy, and have done so. Furthermore, I understand and accept that I am precluded from using lack of reading as a defense against all remedies contained herein.
